1: PARTIES

1.1: This service agreement covers all packages, products, and services specified in the services section (hereinafter referred to as the “Services”) provided by İLGİHOST and the individuals or organizations that purchase these services, create a new membership, or use the website operated under the domain www.ilgihost.com belonging to İLGİNET (hereinafter referred to as the “Customer”). By using the İLGİHOST / İLGİNET website and performing any transactions through it, the Customer shall be deemed to have accepted and agreed to all terms and conditions stated below. www.ilgihost.com URL adresinde faaliyet gösteren internet sitesinin (İLGİ HOST; İLGİNET, olarak anılacaktır.) kullanımı ve bu site üzerinden yapılan tüm işlemlerde; aşağıda belirtilen madde ve koşulların kabulü ile imza altına alınmış sayılacaktır.

1.2: The parties declare, accept, and undertake that all information provided in this service agreement is accurate from the outset.


2: SUBJECT

2.1: This service agreement regulates the services to be provided and the fees to be paid by the Customer to İLGİNET based on the information entered by the Customer during membership registration, orders, transactions performed on the website, and messages submitted through the system. The scope and descriptions of these services and transactions are stated below.

2.2: Membership information consists of the details entered by the Customer during registration within our system, and these details are taken as the basis for all transactions. The Customer has the right to edit and update this information at any time; however, the Customer declares, accepts, and undertakes that all registered information provided within this service agreement is accurate under all circumstances.


3: RESPONSIBILITIES

3.1: İLGİNET is obligated to provide the services ordered by the Customer within the scope of Hosting, Domain Name, SSL Certificate, and IP Address services.

3.2: İLGİNET does not provide support for issues originating from third-party software, security certificates, infrastructure systems, or similar external services requested by the Customer.

3.3: İLGİNET accepts no responsibility for company-related issues occurring on websites created using free website builder platforms such as Wix, Weebly, Site123, Webnode, Strikingly, Jimdo, Mozello, and SimpleSite.

3.4: The Customer acknowledges that İLGİNET only provides DNS record services within the scope of Domain Name services for the providers listed above, and that any issues arising from those third-party companies are not the responsibility of İLGİNET.

3.5: The order confirmation e-mail means that İLGİNET has approved the related order and undertakes to provide the specified service. However, whether to continue or discontinue service to the Customer remains entirely at İLGİNET’s discretion. Therefore, İLGİNET reserves the right to terminate the provided service unilaterally at any time. If İLGİNET terminates the agreement and service unilaterally, the unused remaining service period fee will be refunded to the Customer.

3.6: Payment methods, VAT differences, and the total payable amount generated during the order process will be notified to the Customer by İLGİNET according to the Customer’s monthly or annual billing preferences.

3.7: After order approval and confirmation of transactions, İLGİNET will deliver the control panel, FTP, SQL, and e-mail account usernames and passwords related to the purchased service to the Customer, and the service will become active. The responsibility for the security of related accounts and passwords belongs entirely to the Customer. The Customer is responsible for any damages or losses arising from these matters.

3.8: The Customer undertakes to comply with all declarations, notices, and warnings issued by İLGİNET within the scope of the purchased service. While using hosting services, the Customer agrees to comply with all notifications and announcements published by İLGİNET. The Customer may not distribute, resell, or provide to third parties any free or unlimited services granted within the purchased hosting service, whether for free or for a fee.

3.9: The Customer undertakes not to use the software and programs included within the service to access files or programs without authorization, not to create any problems due to such actions, and not to cause damage.

3.10: İLGİNET is not responsible for damages arising from user errors, electronic attacks, unsolicited e-mails (spam), publications violating the laws of the Republic of Türkiye, immoral or unlawful content, or similar actions carried out by the Customer. Furthermore, İLGİNET reserves the right to claim compensation from the Customer for any damages it may incur due to such actions. The Customer accepts and undertakes in advance to compensate for damages arising from prohibited activities stated in this agreement, whether committed knowingly or unknowingly. İLGİNET reserves all legal rights in such cases and may suspend, terminate, or delete the Customer’s account without issuing a refund.

3.11: The Customer is solely responsible for all files, documents, programs, website content, and e-mail services hosted and used within the scope of the purchased service.

3.12: İLGİNET cannot be held responsible for any material or moral damages arising from misuse of customer data, data content, or all data used via e-mail services within the provided service. İLGİNET is not responsible for data loss caused by possible system-related issues. The responsibility for backing up and storing data belongs to the Customer. Unless otherwise stated in this agreement, all data backup responsibilities belong entirely to the Customer.

3.13: İLGİNET does not provide a separate technical support guarantee for promotional hosting services such as gifts, trial services, or sponsorships offered from time to time. Likewise, unless specifically purchased by the Customer, İLGİNET does not provide backup services and cannot be held responsible for any data loss. Customers who do not purchase an additional backup service are individually responsible for backing up their accounts and user data.

3.14: İLGİNET provides free control panel licenses for VPS, VDS, and dedicated server services for one year only. Panel licenses used beyond one year will be billed separately.

3.15: In sponsorship services provided by İLGİNET, the Customer is deemed to have accepted and undertaken to publish the “İlgiHost” logo with a visible backlink on the homepage of their website within the first 3 days. If the requested conditions are not fulfilled, the sponsorship service may be terminated.

3.16: İLGİNET will carry out domain registration procedures for domains ordered and paid for by the Customer without issue. The domain registration fee paid for the ordered domain belongs to the Customer. İLGİNET may perform operations on the domain name according to the Customer’s requests. Domain registration, modification, and transfer requests submitted by the Customer will be processed as quickly as possible.

3.17: If İLGİNET determines that customer websites or servers hosted within its infrastructure are causing excessive load or harmful effects, İLGİNET reserves the right to suspend the related service.

3.18: The use of trial-account-style applications by reseller customers on İLGİNET servers is strictly prohibited.

3.19: The distribution or copying of any service purchased through İLGİNET, whether paid or free of charge, is strictly prohibited.

3.20: Hosting any illegal content or files on İLGİNET Turkey servers is strictly prohibited.


4: TERM

4.1: The rights and obligations specified by the parties under this agreement become effective once the order and payment process are submitted to İLGİNET through the internet environment.

4.2: The duration of this agreement is limited to the payment period selected by the Customer during the order process for the related service.

4.3: Unless the Customer notifies İLGİNET at least 10 business days before the expiration of the agreement that they wish to terminate the service, the agreement shall automatically renew under the same terms and conditions for the same duration. İLGİNET reserves the right to make pricing changes.


5: FEES & PAYMENTS

5.1: The fee payable for the services specified in this agreement is the amount stated during the order process. VAT will be added to the specified prices afterward, calculated, and reflected to the Customer during billing. CPU and RAM usage are subject to usage limits. In case of exceeding the allocated limits, the Customer may be billed additionally.

5.2: İLGİNET reserves the right to make future changes to prices and tariffs without prior notice. The Customer declares, accepts, and undertakes to accept any changes arising from such pricing updates.

5.3: Fees are calculated and paid in Turkish Lira based on the effective selling exchange rate of the Central Bank of the Republic of Türkiye on the invoice date.

5.4: Payments must be completed within 5 (five) business days from the invoice date. If an automatic credit card payment instruction exists, payment will be collected automatically from the credit card. Otherwise, payment must be made manually to the bank accounts specified in the Customer panel or directly to İLGİNET.

5.5: In the event of delayed payment, İLGİNET reserves the right to issue an exchange rate difference invoice if applicable.

5.6: İLGİNET reserves the right to suspend, reactivate, or cancel the related service until the Customer completes the payment process. No rights may be claimed for any unpaid service.


6: SUSPENSION

6.1: In cases involving payment-related problems, credit card authorization issues, or violations of the provisions regarding rights and obligations stated in this agreement, İLGİNET reserves the right to suspend all services provided to the Customer, including e-mail, web, and FTP accounts.

6.2: During the suspension period, the Customer will not be able to access e-mail, web, or FTP services, and e-mail accounts may be blocked, causing incoming e-mails to be rejected.

6.3: If İLGİNET detects that limited or unlimited hosting services are being used primarily for storage or archive purposes, it reserves the right to suspend the related service without prior notice to the Customer.


7: TERMINATION

7.1: If the Customer acts contrary to any provision of this service agreement, fails to fulfill the responsibilities and commitments undertaken, and/or if the information declared at the beginning of the agreement is determined to be inaccurate, or if the suspension period mentioned above exceeds 7 days, İLGİNET reserves the right to terminate the agreement unilaterally without any prior notice or warning.

7.2: In the event of termination as described in Article 7.1, the Customer declares, accepts, and undertakes that they shall not request a refund for the last paid service period regardless of the remaining duration, and that they will pay all current receivables and a penalty compensation amount equivalent to 5 times the contract fee valid on the termination date.

7.3: The Customer has the right to terminate this agreement at the end of the service term without providing any reason, provided that written notice is given at least 10 days before the expiration date of the agreement.

7.4: If the agreement is terminated by the Customer before the end of the service term, the Customer declares, accepts, and undertakes to pay in advance and in full one-half (1/2) of the remaining fees due until the end of the agreement period.


8: CONTACT & NOTIFICATION ADDRESSES

8.1: The Customer declares, accepts, and undertakes that the postal addresses specified during the order process shall be considered the legal notification addresses for all notices arising from this agreement.

8.2: Any notification sent to these addresses shall be deemed legally delivered even if it does not physically reach the Customer. Unless address changes are notified to us in writing, the previously provided addresses shall remain valid.

8.3: İLGİNET may send messages, information notices, warnings, payment notifications, account statements, and account activity reports to the electronic mail address assigned to the Customer during the agreement period. The Customer declares, accepts, and undertakes that they may not claim that such electronic notifications were not received, and that these notifications shall be deemed legally delivered 1 day after being sent.


9: DEFAULT IN PAYMENT

9.1: If the Customer fails to complete payment within 7 days following the application or invoice date for the purchased services, the Customer shall be considered in default. In such cases, İLGİNET may issue an exchange rate difference invoice and may also charge a monthly late payment interest of 5% starting from the invoice date. The Customer declares, accepts, and undertakes to pay the related late payment interest and exchange rate difference invoice.

9.2: If İLGİNET initiates legal action or enforcement proceedings for the collection of receivables arising from this agreement, the Customer declares, accepts, and undertakes to pay a monthly late payment interest of 5%, a penalty fee amounting to 20% of the outstanding debt, attorney fees amounting to 10% of the debt, and all other legal expenses.

9.3: The Customer declares, accepts, and undertakes that in the event İLGİNET applies for precautionary attachment or precautionary injunction through legal channels for the collection of receivables arising from this agreement, İLGİNET shall be authorized to obtain such decisions without collateral; however, if courts require collateral despite this, all commissions, fees, and costs arising from letters of guarantee obtained from banks shall be paid by the Customer, and the Customer shall raise no objection regarding these matters.


10: REFUNDS & SERVICE CANCELLATION

10.1: The Customer may cancel the hosting service order within 15 days without any conditions, explanations, or obligations and request a refund in accordance with this service agreement. Following such a request, the Customer’s reason will be evaluated and, if found justified, the paid amount will be refunded within 30 business days. Domain registrations, SSL security certificates, server and installation service fees, software licenses, and other non-refundable service items cannot be refunded. If such services are included in the Customer’s order, the related amounts will be deducted from the refund amount. Refunds will be processed through the same payment method used by the Customer. (Example: Payments made by credit card will be refunded back to the same card.)

10.2: If the Customer is unable to benefit from the purchased services for 15 (fifteen) consecutive days due to faults directly caused by İLGİNET (excluding interruptions caused by Türk Telekom, natural disasters, or force majeure events), the Customer may request a refund. Upon such a request, the refund amount will be calculated after deducting the months during which the service was actively used and refunded within 30 business days. İLGİNET’s official logs and records shall be considered the sole valid evidence in determining such faults. Documents provided by third parties or external institutions will not be accepted by İLGİNET.

10.3: If the Customer makes unfair comments, statements, slogans, accusations, or similar actions in virtual or real environments that may damage the reputation or image of İLGİNET, İLGİNET reserves the right to cancel, terminate, or permanently suspend the related service without refund for the remaining service period and may refuse to provide any future services to the Customer.

10.4: If the purchased service causes the server to experience excessive load due to any reason and makes it difficult or impossible for İLGİNET to continue providing the service, İLGİNET reserves the right to cancel the service, refuse refunds for payments made, and claim compensation for any damages incurred.

10.5: İLGİNET may combine certain services into promotional or bundled packages. If campaign packages include additional services such as domain registration, SSL certificates, dedicated IP addresses, live support modules, installation services, or promotional gifts, the fees related to these services are not included in the refundable amount during the cancellation or refund process.

10.6: For physical and virtual server services provided by İLGİNET, if payment is not completed by the final due date and within an additional 12-hour grace period after the due date, İLGİNET reserves the right to suspend or permanently delete the service. The Customer declares, accepts, and undertakes that İLGİNET shall not be held responsible for any resulting damages, losses, or data loss.


11: FAIR USAGE POLICY

11.1: Services advertised as “UNLIMITED” or “LIMITLESS” do not mean that the Customer may consume unlimited server resources. These expressions indicate that no predefined package limit is imposed on the Customer. However, resource usage may not exceed 5% of the total server or system capacity. The Customer may use the provided resources in a manner that does not negatively affect other users on the same server or infrastructure. If usage beyond fair usage limits is detected, İLGİNET reserves the right to suspend, terminate, delete, or refuse service.

11.2: İLGİNET determines the limits and scope of the Fair Usage Policy. İLGİNET reserves the right to increase or decrease these limits at any time without prior notice.

11.3: For hosting and reseller services advertised as “UNLIMITED,” separate file (inode) limits are applied to each package. İLGİNET reserves the right to increase or decrease these inode limits at its sole discretion.


12: AUTHORIZED COURTS & ENFORCEMENT OFFICES

12.1: This service agreement consists of 12 articles and related sub-sections and has been read, understood, and accepted by the parties electronically. Submission of the order through the internet to İLGİNET shall be deemed as acceptance of this agreement. İLGİNET reserves the right to add, remove, or modify articles and/or sub-sections whenever deemed necessary. The Customer declares, accepts, and undertakes acceptance of such changes in advance.

12.2: In the resolution of any legal disputes arising from the implementation of this service agreement, the courts and enforcement offices of Estonia shall have exclusive jurisdiction and authority.

All registered users shall be deemed to have read and accepted our “Service Agreement” and related “Service Policies.”
